Terms of Use for the GROUPnTRAVEL platform

The Terms of Use (we may refer just "Terms") apply when you use access www.groupntravel.com (we may refer as just "Service").
Glossary

Beta Edition = the stage of the platform, an intermediate stage in the life of a product or a start-up, which contains the most major functionalities, but is not yet complete. Sometimes these versions are released only to a select group of people, or the general public, for testing and feedback

The Reservation Idea = the main objects of the platform. A reservation idea is an intermediate stage for a tourist initiating a booking request to the properties registered

The Initiator = the user who created the reservation idea and has all the rights to confirm, cancel the reservation or occupy / release the places (beds) available in the reservation idea

The Property = the accommodation unit for which you can register reservation ideas - direct bookings or manual bookings

The Administrator = the user who registered the Property account on the platform or who was named by another administrator user

Backoffice = the platform private areas where only an Administrator have access. On the Backoffice an Administrator can manage his properties and reservations

Manual bookings = reservations manually entered by the Administrator
The service is administered by Continent SRL Press and Publishing Group (or "We", "Our"), with the address in Dr. Ștefan Capșa street Nr.11, Attic, 050485, Sector 5, Bucharest, Romania.
Your access and the use of the Service are conditioned by the acceptance and reading of the Terms of Use and the Privacy Policy that applies to all visitors or users accessing or using the Service. If you do not agree with any part of the Terms or the Privacy Policy then do not access the Service.
By accessing or using the Service You agree to be bound by these Terms. We process your personal information in accordance with the www.groupntravel.com/privacy. These Terms supplement the Privacy Policy. If you disagree with any part of the Terms or the Privacy Policy then you may not access the Service.
Brief description of the Service
The Service aims to help tourists plan their vacation more easily with their friends through reservation ideas. The service is also presented in the form of a search engine where tourists can discover the properties near them or near tourist and geographical attractions. The Service presents the property details, contact info, availability of the rooms and offers, as they were registered directly by the Administrator on the platform. Therefore, the Service is not responsible for the clarity, novelty and / or conformity of the information presented about properties, their administrators being directly responsible.
The Service is addressed to all the owners, administrators and managers of accommodation properties with an average capacity, optimally 3-20 rooms. With the help of the tools provided, the page can be personalized with information on the description and facilities of the location, contact details, proximity tourist attractions, the specificity of the rooms, rates per rooms according to season, different type of offers like early booking and group booking, reservation policy and conditions.
Content
The Service allows you to publish content ("Content"), meaning public content on the Internet, links, record information, shared content through other platforms (WhatsApp, LinkedIn, Facebook and other social media) or email and make available certain information, text, graphics, to help you providing users the public information about the Property, room details, availability of rooms and current offers. You are responsible for the Content you publish by using the Service, including the legality, reliability and adequacy of the Content.
By publishing Content through the Service, you authorize us to use, publicly modify, publicly display, reproduce or distribute such Content through the Service. You retain all rights to any Content that you distribute, publish or post on or through the Service and you are responsible for protecting these rights. You agree that this license includes the right to make Your Content available to other users of the Service, who are also subject to these Terms, or public.
You represent and warrant that: (i) the Content belongs to you (you own it) or you have the right to use and authorize us as provided in these Terms, and (ii) publishing the Content on or through the Service does not violate the privacy rights , advertising, copyright, contractual rights or any other rights of any other person.
Registering a user account connecting with the Facebook or Gmail account
The following information is received from Facebook: name, email address. The phone number is not updated automatically. It must be entered manually. For more information on using your personal data, please take a look and read the Privacy Policy of the website.

Methods of carrying out the correspondence
The Service does not provide any guarantee for the receipt by email of the notifications or reports sent, payment estimates or other notifications of reservations.
Tourist account
Once registered on the platform all users benefit from the Tourist account and can create reservation ideas to any of the properties published in the platform or can join other ideas to which they have access.

Reservation ideas - tourist perspective
Reservation ideas are not bookings themselves. To become a real reservation, a reservation idea must be confirmed by the Administrator. In addition, even if a reservation idea has been confirmed, the responsibility and guarantee of the reservation is assumed by the parties, the GROUPnTRAVEL platform declining any responsibility in this regard. If a reservation idea has not been confirmed, then the rooms appear free during the selected period, so that other users can create reservation ideas during the same period.
The reservation idea remains anonymous until the originator of the idea sends the reservation request to the Property Administrators, but it can be seen on the property calendar. At that time, when the reservation request is sent, the contact details of the initiator will be printed on the reservation idea page, visible to the Property. Also, at the bottom of the reservation page, the parties (the Initiator and the Administrator) are provided with visible comments to all who have the rights to view the reservation.
Reservation ideas have a unique link so that they can only be found by users who have the URL. Reservation ideas have visibility settings, so their access can be restricted depending on the Initiator's option.
Only the Initiator and the users registered in the platform, with the right of access to the reservation, can occupy or release the places available in the reservation.
Only the Initiator of a reservation may change the status of a reservation, request a reservation or cancel the reservation.
Reservation ideas can be canceled at any time by either party, Initiator or by the Administrator.
GROUPnTRAVEL recommends that you pay the reservations directly to the owner, upon arrival at the location. GROUPnTRAVEL is not a tour operator and does not financially book property reservations.
All our services are offered free of charge. GROUPnTRAVEL disclaims any responsibility for the use of the data or information included in the website or in the documents or emails generated through the Service. These data are distributed for information purposes only. Therefore, users are required to take all necessary precautions before using this data, which they use at their own risk.
Estimated bill
The estimated bill is calculated based on the rates introduced directly by the Administrators in the GROUPnTRAVEL platform, but does not represent an official offer from these properties. The estimate and all the details of the reservation can be changed at any time, and the document cannot be interpreted as an invoice or as a fiscal document.
The data included are disseminated for informational purposes only. Therefore, all the details of the reservation, both the calendar and the payment details must be confirmed directly with the Administrators. GROUPnTRAVEL disclaims any responsibility for the use of the data or information contained herein. Therefore, participants are required to take all necessary precautionary measures before using this data, which they use at their own risk.
Property Account
All information entered in the platform must be real and in accordance with the profile and purpose of the platform, non-compliance with this requirement entailing suspension of the account from the platform.
Your access to the backoffice area of the registered pages is possible only by virtue of the administrator status of the page.
Seasonal settings, rooms and offers
In order to register rates, it is necessary to register at least one season. All rates are customizable per season.
The selection of facilities or other reservation policies is made easily by choosing from the preset elements.
On the room settings page, you can add rates, photos and other facilities for each room. If you want a room not to be public for a period of time, you can select the status in the hidden room.
The rate of a room is set per season. If the season has been canceled, the rates will no longer be valid.
If a room is deleted it will result in the cancellation of all ongoing bookings using that room.
The platform allows the creation and distribution of offers, customization for various forms of discount, by period, group or by number of rooms. Once created, offers can no longer be edited, they can only be deleted. If an offer is deleted, it will result in the cancellation of all ongoing reservations using that offer.
The offers can be customized according to the type selected, the period, the selected rooms and the reduction granted.
The discount will appear on the payment estimate for all bookings that include the offer.
Tourist attractions
The properties can have several tourist attractions attached so that they can be more easily identified in the platform and located. Choose the most attractive ideas that are closely related to your property. You can attach up to 20 tourist or geographical attractions.
Publishing the page
Once created and customized, the resulting page can be published and thus made public to all search engines and all online visitors. The page will remain in their archive even after the subsequent change of status from public to private.
Published properties become available to the creation of the reservation ideas.
The service will change the status of the page in private, if any of the conditions of the publication are invalid (i.e. if the rooms are not defined and visible, the rates or if the required sections are not complete).
Adding or deleting additional administrators
An administrator can add multiple administrators by adding its email address, email used to log in the platform. The right to close the property account rests only with the administrators who have full rights on the platform.
Adding a manual booking
Administrators can add confirmed or unconfirmed reservations. The confirmed reservations change the color on the reservation calendar and do not allow the overlapping of other room reservations during the selected period. Unconfirmed bookings allow the addition of other non-confirmed bookings or tourist reservation ideas.
Confirmation or decline of tourist reservation ideas
Reservation ideas are anonymous until the Initiator submits the reservation request to the Property. Ideas can be confirmed or declined. If the idea is declined, it will be temporarily blocked.
Only the Administrator can unlock it later.
Reservation ideas can be canceled at any time by either party, by the Initiator or by the Administrator.
Booking calendar
Reservation calendars have many forms in the GROUPnTRAVEL platform.
Public calendars
They can be displayed on the published pages of the property, on the home page or on the pages of rooms and offers - depending on the privacy and transparency settings of the calendar. They have general availability, but do not show in-detail information about reservations.
Calendar: Reservations of the day
It is available only to the Administrator, and its main function is to search and view all the reservations and the availability of the rooms from a certain day.
Departures and arrivals - complete booking calendar
It is only available to the Administrator and is the main calendar that presents on a single page the situation of all the rooms and reservations for a limited period of time.
Closing the property account
Once a property account is closed, all current or future bookings will be canceled. Account information will no longer be updated.
Closing the user account
We may close or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you have violated the Terms.
Upon termination, the right to use the Service will cease immediately. If you wish to close your account, you may simply discontinue using the Service or close your account directly from the platform.
Access to this account will be restricted and data related to the account, activity or history, registered properties, reservations or reservation ideas will no longer be accessible. All future confirmed reservations, if any, will be canceled. It remains your obligation to cancel or update the publication of any pages or information published on the Internet, if any.
Intellectual property
The Service and its original content, meaning internet published web pages, the source code of any type of files, public or private, static public resources (images and any type of files), all resources accessed from the web domains www.groupntravel.com or www.groupandtravel.com (excluding the content provided by Service users), but also and their features and their functionality are and will remain the exclusive property of the Service and the rights holders. The Service is protected by copyright, trademark, and other laws of both Romania and foreign countries. Our trademarks, Service content and trade dress may not be used in connection with any product or service without Our prior written consent.
Fair use
You may use website pages or the shared posts only accordingly with the intention and the theme of the Service. The web pages, the source code of any type of files, public or private, static public resources (images and any type of files), all resources accessed from the web domains www.groupntravel.com or www.groupandtravel.com or other Service published content may not be redistributed or reproduced in any other way, shape, or form without Our written permission. Failure to do so is a violation of copyright laws.
References to GROUPnTRAVEL platform
You may link to any of the Service pages, if the linking is distributed in the same thematic environment with the Service. However, Service pages or Service content may not be embedded in a frame or in a software program, public or private, by an automated reading procedures from the referring site, without Our written permission.

Our Service may contain links to third-party web sites or services that are not owned or controlled by Us.
We have no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services, accessed from the Service. You further acknowledge and agree that We will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.
Limitation of liability
In no event We will, nor Our rights holders, associates, shareholders, directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not We have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether expressed or implied, including, but not limited to, the implied warranty of merchantability, fitness for a particular purpose, design, accuracy, capability, sufficiency, suitability, capacity, completeness or availability.
We or Our subsidiaries, affiliates, and our licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) The Service will present always correct data, real or without any inaccuracies or any type of errors or inconsistencies; c) any errors or defects will be corrected; d) the Service is free of viruses or other harmful components; or e) the results of using the Service will meet your requirements.
Warranties
The Service is provided without any kind of warranty. There are no guarantees that use of the Service will not be subject to interruptions. All direct or indirect risk related to use of the site is borne entirely by the User.
The Service may contain inaccuracies or errors. We do not make any guarantees regarding the accuracy of the Service or its contents. If you discover that the Service or its contents contains errors, please contact us so We may try to correct them.
Legal liability and jurisdiction
These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. These Terms set forth herein supersede all prior Terms of Use.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have.
Amendments
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will publish a notification of our Facebook Official page www.facebook.com/groupntravel/ and we will try to provide at least 30 days notice prior to any new terms taking effect.
By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
